Cannot get rid of the terms of condition banner

I run a blackberry bold and have been running tether for about a year with no problems. Recently I had to have a total reboot of the blackberry and therefore had to start again. After downloading the tether back onto the blackberry I get a Terms of condition banner which is overlaid onto the tether. There is no way of acceptance box or any way to get rid of it that I can see. It actually highlights the htt://tethercom/termsofservice. on clicking on this it takes me through to the tether site showing me the trms of service. More than frustrating. Making things worse is as far as I can see. No way of contacting tether except through the live assistance of to date I have not seen activated. Any out there can help me
